Virginia Couple Accused Of Embezzling $400K From Mechanical Contracting Company In Civil Suit

From the Virginia-Pilot on 12/16/2014:

A local mechanical contractor is suing its former accounting manager and her husband, saying the couple embezzled more than $400,000 to buy boats and real estate and open accounts in their names.

The lawsuit accuses Chesapeake resident Lynda C. Johnson of taking unspecified sums of money from Comfort Systems of Virginia Inc., a plumbing, sheet-metal and heating, ventilation and air-conditioning company, and covering her tracks by disguising the transfers as company expenses. Her husband, Roger Dale Johnson, helped, according to the complaint filed this month in Circuit Court.
Police are investigating, and criminal charges are pending against Lynda Johnson, Officer Kelly O'Sullivan, a police spokeswoman, wrote in an email.

Lynda Johnson had access to Comfort's financial records and began depositing company money into the couple's joint bank accounts in August 2013, according to the suit. She wrote checks to petty cash, wired funds and obtained cashier's checks, the suit says.

The Johnsons then used the money to buy and improve real estate, open investment and retirement accounts and purchase multiple boats: a 2012 Bayliner 170, a 2007 Four Winns 318 and a 2000 Sea Ray 290 Sundancer, the lawsuit says.

It accuses the couple of fraud, civil conspiracy and conversion, and seeks to recover what the company lost.

Louisiana Man Accused In Civil Suit Of Embezzling $850 From Staffing Company In Payroll Scheme

From the Louisiana Record on 12/5/2014:

A staffing agency is suing one of its shareholders it claims embezzled $850,000 in payroll funds in addition to hundreds of thousands more in business receipts.

SCS Enterprises Inc. filed suit against Dean St. Pierre in the 24th Judicial District Court on Sept. 23.

SCS Enterprises Inc. alleges that St. Pierre was a shareholder in the company in January 2010 when it discovered he had manipulated the company’s payroll, making bank draws from the company bank account in excess of his salary. The plaintiff contends it ultimately calculated $850,000 in funds that the defendant had taken. SCS Enterprises Inc. asserts that after being confronted with the evidence St. Pierre admitted to being liable for the missing funds in exchange for a 90 percent ownership stake in the company being transferred to the other shareholder, Russell Saluto, with St. Pierre retaining a 10 percent ownership stake.

However, the plaintiff claims that after the transfer it found more evidence of alleged embezzlement on behalf of the defendant, amounting somewhere between $307,000 and $612,421, that he allegedly took in the form of payments that were made out to the company by customers, but were diverted to a separate bank account. SCS Enterprises Inc.  alleges that because the previous shareholder transfer agreement was applied to the the $850,000, the remaining amount subsequently discovered should be repaid.

Damages are sought for the return of all allegedly misappropriated funds as well as attorney’s fees.

Former Oil Company Accountant In Louisiana Accused Of Embezzling Nearly $1.8 Million In Civil Action

From the Louisiana Record on 12/1/2014:

NEW ORLEANS – A local oil company is suing an accountant it claims embezzled a total of $1,798,000 betewen October 2009 and May 2014.

Clovelly Oil Co. LLC filed suit against Paul E. Gardner in the Orleans Parish Civil District Court on Sept. 11.

Clovelly, a limited liability company located at 650 Poydras St. in New Orleans, allegedly hired Paul E. Gardner in 2008 to provide accounting assistance for the company. As part of Gardner’s duties, he was given access to Clovelly’s bank accounts and had the capacity to make electronic payments via Automated Clearing House (ACH) in association with Whitney Bank, the suit says.

Beginning in 2009, Gardner allegedly made illicit, illegal and unauthorized deposits from Clovelly’s bank accounts, via the ACH, into his personal bank accounts, the suit claims. This allegedly continued for another four and a half years, culminating in over one hundred unauthorized withdrawals from Clovelly’s bank accounts.

Gardner has acknowledged his wrongdoing by arranging for partial repayment in the sum of $150,000 out of the $1,798,000, the suit says. However, Gardner has failed to pay back the debt in full and remains liable to Clovelly for the aforementioned amount as well as the lesser credit of $150,000.

Netflix Sues Former VP of IT Operations Over Alleged Vendor Fraud & Kickback Scheme

From Bloomberg on 11/26/2014:

Netflix Inc. (NFLX) sued former technology executive Mike Kail, who joined Yahoo! Inc. (YHOO), for fraud, claiming he took cash kickbacks from two suppliers and had deals to receive stock, money or gift cards from other vendors.

Kail received commissions worth 12 percent to 15 percent of payments made to two companies, Netflix said in a complaint filed Nov. 24 in state court in San Jose, California. The vendors received almost $4 million in payments since 2012, said Netflix, the world’s largest subscription streaming service.

Kail, a former vice president of information technology operations, was in charge of negotiating contracts with companies that supplied products and services supporting Netflix’s computer systems, Netflix said. He hid the payments by having them paid to his personal consulting company Unix Mercenary LLC, according to the lawsuit. Kail left Netflix in August to join Yahoo as chief information officer.

E-mails showed that Kail would approve payments to the vendors and then invoice them for his cut, according to the lawsuit. In one November 2013 e-mail, Kail wrote a vendor that he’d approved its invoices “so would be good to understand who to work with on getting my portion paid.”

Anne Espiritu, a spokeswoman for Sunnyvale, California-based Yahoo, declined to comment. A voice-mail message left at Yahoo for Kail wasn’t immediately returned.

The commissions belonged to Netflix, the Los Gatos, California-based company said in the complaint, which alleges fraud, breach of fiduciary duty, unjust enrichment and unfair business practices, and seeks unspecified damages.

3 Florida Companies Sue Former Bookkeeper & Husband - A Deputy Sheriff - In $500K Embezzlement Case

From the Tampa Bay Times on 11/14/14:

A trio of Hillsborough County companies is suing a former bookkeeper and her husband — a Hillsborough sheriff's deputy—after she was arrested on charges of embezzling half a million dollars from them.

The lawsuit filed by the companies last week alleges Karla Reigner's husband, David Reigner, knew his wife was stealing from the plumbing and air conditioning repair businesses and used a company credit card to spend more than $7,000 on kitchen cabinets from Home Depot for himself.

David Reigner is still working as a sheriff's deputy after a Florida Department of Law Enforcement investigation cleared him, spokesman Larry McKinnon said.

"It was the FDLE that did the investigation and they found that he was not involved," McKinnon said.

Karla Reigner was arrested by FDLE in August on charges of embezzling more than $500,000 from Scott's Services, Inc., Princeco, Inc. and One Hour Air of Central Florida. Reigner pleaded not guilty in October, according to Hillsborough County court records.

According to the lawsuit, Wells Fargo contacted owner Scott Vigue in December 2012 about "suspicious charges" made on company credit cards. When Vigue contacted her, Reigner said the company card looked like her personal card and she used the company card by mistake. She paid them $2,550 as reimbursement, the lawsuit said.

Reigner was fired. An audit found she stole $517,348, and used company credit cards at gas stations, drug stores, travel sites and restaurants, the lawsuit said.

Reigner began working for the companies in March 2011, the lawsuit said. ...
